OVERVIEW

This website is operated by SLAM Learning Centres. Throughout the site, the terms “we”, “us” and “our” refer to SLAM Learning Centres. SLAM Learning Centres offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply  to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

We reserve the right to refuse any order/booking you place with us. These restrictions may include orders/bookings placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or refuse a booking, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. 

You agree to provide current, complete and accurate purchase and account information for all bookings made at our website. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

In no case shall SLAM Learning Centres, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. You agree to indemnify, defend and hold harmless JSLAM Learning Centres and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

 

SECTION 14 - SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

 

SECTION 15 - TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

 

SECTION 16 - ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

 

SECTION 17 - GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of 222 Governor Road, Braeside, Victoria, 3195, Australia.

SECTION 18 - USE & COLLECTION OF PERSONAL INFORMATION

To provide you the Services, we must collect Personal Information relating to an identified or identifiable natural person (“Personal Information”). We collect Personal Information you provide us, from your use of the Services, and from other sources. Here are the types of Personal Information we collect about you:

  1. Information you provide us. When you register for our Services, subscribe to our blog(s) or newsletter(s), purchase and/or register domain names, use any of our Services; and/or when you contact us directly by any communication channel (e.g. contacting SLAM via the chat, form or email functions), you may provide us Personal Information, such as name, email address, phone number, payment information, information you include in your communications with us and with other users on our platform, and Personal Information contained in scanned identification documents (such as an ID card, driver’s license, passport, or official company registration documents).  

  2. Information we collect when you use the Services. When you visit, download, and/or use any of our Services, we may collect aggregated usage Personal Information, such as Visitors’ and Users’ browsing and ‘click-stream’ activity on the Services, session heatmaps and scrolls, non-identifying Personal Information regarding the Visitor’s or User’s device, operating system, internet browser, screen resolution, language and keyboard settings, internet service provider, referring/exit pages, date/time stamps, etc

  3. Information we collect from other sources. We may receive Personal Information about you from third-party sources, such as i) security providers , fraud detection and prevention providers for example to help us screen out users associated with fraud, ii) social media platforms, when you log-in or sign-up using your social media account, we may receive Personal Information from that service (e.g. your username, basic profile Personal Information) and in some cases, we may collect Personal Information from lead enhancement companies which help us to improve our service offering; iii) advertising and marketing partners in order to monitor, manage and measure our ad campaigns.

To provide our Services, we collect Personal Information about our Users.

The Personal Information comes from you when you visit or use our services, Personal Information we collect automatically, and Personal Information we collect from other sources.

We also collect information that is provided to us by SLAM jobs candidates (“Applicants”), when they apply to any of the open positions, by email or otherwise.

SECTION 19 - PHOTOGRAPHY OF STUDENTS IN SLAM CENTRES

SLAM Learning Centres may take photos of students in class and use these for various purposes including but not limited to: our website, social media, in centre media & advertising campaigns. The uses of these photos may change at anytime at the discretion of SLAM Learning Centres management. We request the right to not notify parents / guardians of these changes if they occur. 

 

All SLAM Centres are fitted with CCTV which runs 24/7, and thus, keeps video and audio evidence of our students on file for up to five (5) years. It is at the discretion of SLAM Management whether this footage is released to parents/guardians.

​

Please notify SLAM Management upon joining the program if you do not wish for us to take photos of your son / daughter / dependent. CCTV is on the other-hand a mandatory requirement for SLAM.

You can review the most current version of SLAM's Payment Terms at any time below. We hold the right to change or update our payment terms at any time (at our discretion), without notification to current customers, or future customers.

SECTION 4 - GENERAL PAYMENT TERMS

SLAM Operates on a direct debit based system. We will provide relevant documentation for this after completion of SLAM’s Free Triple Trial. 

 

SLAM will debit for lessons every 4 weeks, regardless if a student is or is not present in class. 

 

We will always endeavour to provide absent students with class videos, however, in the event that this is not possible, the charge will still occur. 

 

SLAM will not charge on weeks where a student's class falls on a public holiday. Students are still welcome to use all other optional resources that week. 

 

SLAM is closed over all school holidays (following a public Victorian highschool timeline / term dates).

 

Payment processing fees will apply. All payment processing fees are charged by SLAM’s billing provider. Further information on this is provided when direct debit is set up. 

 

A customer setup fee is also applied (customer setup fees are charged by SLAM’s billing provider) of $2.20.

SECTION 5 - SIBLING DISCOUNTS

SLAM will provide a 5% discount on fees for all siblings of students. 

 

No payment processing fees will apply for siblings. 

 

(Discounts will be applied to students in order from youngest to oldest).

 

The above offer is not available in conjunction with any other offer or sale.

 

SECTION 6 - UNPAID ACCOUNTS / FAILED DIRECT DEBIT ATTEMPTS

All SLAM Payments are due prior to class. Unfortunately, a failed direct debit will result in a charge per failed direct debit attempt of $9.90 (charged by SLAM’s billing provider, not SLAM). Additionally, a payment processing fee will apply on successful direct debit (charged by SLAM’s billing provider, not SLAM).

SLAM Will try direct debit again the following day (upon contacting you). 

​

If this too fails, the SLAM Team will be in touch to arrange a debit date. It must be noted, that, if this is the case another unsuccessful payment charge will occur (charged by SLAM’s billing provider, not SLAM).

 

Additionally, a payment processing fee will apply on successful direct debit (charged by SLAM’s billing provider, not SLAM).

Unfortunately students with unsettled accounts will not be able to enter class unless a predetermined payment extension is put into place (we will always do our best to work with you).
